Opinio Juris Sive Necessitatis

LEGAL OPINION
Question: Dari beberapa putusan pengadilan dalam dan luar negeri, hakim ketika membuat pertimbangan hukum ada menyebutkan perihal istilah opinio necessitatis. Maksudnya apa?
Brief Answer: Secara sederhana, opinio necessitatis atau yang juga dikenal dengan istilah “opinio juris”—memiliki kelengkapan bunyi sebagai “opinio juris sive necessitatis”—dapat diartikan secara harafiah sebagai adanya keperluan atau kemendesakan suatu pembentukan norma hukum baru atau setidaknya suatu pola pandang berhukum baru, yang kemudian dimulai dan dibakukan lewat praktik kebiasaan peradilan itu sendiri yang didasari oleh suatu keyakinan bahwa “begitulah hukumnya” meski hukumnya itu sendiri tidak secara eksplisit menyatakan demikian adanya.

Opinio juris tampaknya menjadi istilah yang bermula lahir dari praktik kebiasaan hukum Mahkamah Internasional (IJC), sebagaimana diterangkan oleh Legal Information Institute yang SHIETRA & PARTNERS kutip dari sumber https://www.law.cornell.edu/wex/opinio_juris_international_law :
“In customary international law, opinio juris is the second element (along with state practice) necessary to establish a legally binding custom.  Opinio juris denotes a subjective obligation, a sense on behalf of a state that it is bound to the law in question.  See ICJ Statute, Article 38(1)(b) (the custom to be applied must be ‘accepted as law’).

As the ICJ stated in the North Sea Continental Shelf cases of 1969, ‘Not only must the acts concerned amount to a settled practice, but they must also be such, or be carried out in such a way, as to be evidence of a belief that this practice is rendered obligatory by the existence of a rule of law requiring it.’ [North Sea Continental Shelf, Judgment, I.C.J. Reports 1969, pp. 3, 45, para. 77.]
“Nonetheless, a state's motives can change over time, and that it is not necessary that opinio juris be a significant impetus for each instance of action. As Judge Lachs wrote in a dissenting opinion in the North Sea Continental Shelf cases, ‘At successive stages in the development of the [customary] rule the motives which have prompted States to accept it have varied from case to case. It could not be otherwise. At all events, to postulate that all States, even those which initiate a given practice, believe themselves to be acting under a legal obligation is to resort to a fiction, and in fact to deny the possibility of developing such rules.’ [North Sea Continental Shelf, 1969 I.C.J. 4, 232-33 (Feb. 20) (dissenting opinion of Judge Lachs).]
This logical framework makes sense for existing norms of customary international law, but it becomes problematic in the context of new or emerging customary rules. If a practice is not currently governed by customary international law, then it is illogical to inquire into a state's beliefs about the legality of engaging in or abstaining from that practice, i.e., to ask whether it believed that its practice was in compliance with a law that does not yet exist.
“This paradox may be resolved to some extent by the idea of ‘crystallization’ of customary international law, in which practice and legal obligation evolve jointly and eventually ripen into law. Under one model, this process occurs in three stages: first, some States engage in a given practice for reasons other than a sense of legal obligation (e.g. political expediency, economic gain, courtesy, etc.); next, States reinforce the practice by engaging in it or making claims based upon it, creating loops of reciprocity and reliance based on expectations that the practice will continue; finally, as these relationships expand in number and complexity, they eventually harden into a general rule.
“In this final stage, as more States become aware of the conduct and actively participate or at least passively acquiesce to the practice, the States’ actions begin to be undergirded by a belief that they are complying with an emerging customary rule.”
Salah satu contoh implementasinya dalam praktik peradilan di Indonesia, ialah putusan Pengadilan Tinggi Bandung tingkat banding register Nomor 141/Pdt.G/2007/PTA.Bdg. tanggal 27 Desember 2007, memberikan pertimbangan hukum sebagai berikut:
“Menimbang, bahwa setelah mempelajari berkas perkara dan semua surat yang berhubungan dengan perkara ini serta memperhatikan keteranganketerangan yang dikemukakan Pembanding dan Terbanding beserta pembuktiannya, pertimbangan hukum dalam putusan Majelis Hakim Tingkat Pertama tentang Rekonpensi, Majelis Hakim Tingkat Banding menyatakan tidak sependapat, oleh karena itu Majelis Hakim Tingkat Banding akan mengadili sendiri dengan pertimbangan sebagai berikut;
“Menimbang, bahwa keterangan serta alasan-alasan yang dikemukakan Termohon / Pembanding dalam jawabannya tanggal 20 Maret 2007 pada hakekatnya telah menggambarkan betapa besarnya tanggung jawab seorang ibu dalam peran dan fungsinya sebagai pemelihara, pengasuh dan pendidik 3 orang anak (anak Pembanding dan Terbanding) demi masa depan mereka, kenyataan ini menjadi fakta hukum yang harus dipertimbangkan, sungguh pun terhadap masalah tersebut bagi Pemohon/Terbanding dalam Repliknya tanggal 27 Maret 2007 tidak memberikan pendapat ataupun sugesti positif (opinio necessitatis) selaku mantan suami dan sebagai ayah kandung dari 3 orang anak, oleh karena itu Majelis Hakim Tingkat Banding berpendapat bahwa selain nafkah dan biaya hidup dan pemeliharaan serta pendidikan 3 orang anak, biaya kontrak rumah juga menjadi tanggung jawab Pemohon / Terbanding.”
Contoh lainnya ialah ketika Mahkamah Konstitusi RI membuat pertimbangan serta amar putusan dalam Perkara No. 065/PUU-II/2004 Pengujian Pasal 43 (1) UU No. 26 Tahun 2000 tentang Pengadilan Hak Asasi Manusia, tanggal 3 Maret 2005, sebagai berikut:
“Menimbang lebih jauh bahwa UU Pengadilan HAM hanya memasukkan dua jenis kejahatan yang terhadapnya asas non-retroaktif dapat dikesampingkan, yaitu kejahatan genosida (genocide) dan kejahatan terhadap kemanusiaan (crimes against humanity). Undang-undang a quo tidak memasukkan kejahatan perang dan kejahatan agresi, meskipun kedua jenis kejahatan ini menurut hukum kebiasaan internasional (international customary law) juga tergolong dalam kejahatan serius terhadap masyarakat internasional secara keseluruhan (the most serious crimes of concern to the international community as a whole). Hal ini dapat dimengerti karena pada waktu itu, tidak ada kebutuhan hukum untuk memasukkan kedua bentuk kejahatan tersebut ke dalam pengaturan undang-undang a quo, khususnya Pasal 43 ayat (1), karena tidak relevan dengan konteks maksud dan tujuan pembentukan Pengadilan HAM ad hoc tersebut;
“Menimbang bahwa pelanggaran berat hak asasi manusia (gross violation of human rights) berbeda dari kejahatan ter*risme yang menurut pandangan sebagian ahli, ter*risme juga merupakan kejahatan yang tergolong ke dalam kejahatan serius terhadap masyarakat internasional secara keseluruhan (the most serious crimes of concern to the international community as a whole), tetapi hingga saat ini belum terdapat definisi hukum yang tepat dan objektif tentang ter*risme yang dapat diterima secara universal, sehingga belum terdapat keyakinan yang dapat diterima umum (communis opinio juris sive necessitatis). Hal ini sejalan pula dengan apa yang dikatakan oleh Omer Y. Elagab, “As concerns terrorism, it is extremely difficult to offer a precise and objective definition which can be universally accepted” (vide Omer Y. Elagab, International Law Documents Relating to Terrorism, Cavendish Publishing Limited, 2000, h. xix).
“Dengan demikian berarti belum terdapat kebiasaan umum yang diterima sebagai hukum dalam praktik pengadilan yang berhubungan dengan terrorisme, sehingga belum dapat dikatakan terbentuk hukum kebiasaan internasional (international customary law), yang merupakan salah satu sumber primer hukum internasional (primary source of international law) sebagaimana dimaksud oleh Pasal 38 ayat (1) Statuta Mahkamah International (International Court of Justice). Padahal, keadaan demikian merupakan kondisi yang harus dipenuhi bagi pembentukan suatu pengadilan ad hoc menurut praktik dan perkembangan hukum internasional;
“Menimbang bahwa berdasarkan uraian di atas, sebagian dari dalil Pemohon yang dijadikan dasar penolakan terhadap pengesampingan asas nonretroaktif adalah dapat dibenarkan sepanjang menyangkut kejahatan-kejahatan biasa (ordinary crimes) ataupun kejahatan luar biasa (extraordinary crimes) yang cukup diadili melalui forum pengadilan biasa dan tanpa harus mengesampingkan asas non-retroaktif.
“Namun, dalil-dalil tersebut tidak dapat digunakan untuk membangun konstruksi pemikiran hukum (legal construction) yang bersifat aksiomatik sehingga melahirkan kesimpulan bahwa hak untuk tidak dituntut berdasarkan hukum yang berlaku surut adalah hak asasi manusia yang bersifat mutlak.
“Sebab, jika konstruksi pemikiran demikian digunakan maka terhadap perbuatan-perbuatan yang tergolong ke dalam kejahatan-kejahatan luar biasa (extraordinary crimes) yang secara universal telah dianggap sebagai kejahatan serius terhadap masyarakat internasional secara keseluruhan (the most serious crimes of concern to the international community as a whole), yang di dalamnya termasuk kejahatan-kejahatan sebagaimana diatur dalam undang a quo, sangat mungkin lolos dari tuntutan hukum tatkala hukum atau undang-undang tidak secara tegas mengatur perbuatan-perbuatan demikian sebagai kejahatan.
“Apabila itu terjadi, maka telah terjadi pelanggaran terhadap suatu prinsip fundamental yang telah diterima secara universal sebagai asas hukum yaitu “tidak boleh ada kejahatan yang dibiarkan berlalu tanpa hukuman” (aut punere aut de dere). Konstruksi pemikiran hukum aksiomatik yang mengabsolutkan asas non-retroaktif, secara rasional, berarti juga harus diartikan sebagai penolakan terhadap mekanisme keadilan transisional (transitional justice) yang merupakan mekanisme penyelesaian pelanggaran-pelanggaran hukum yang terjadi di masa lalu, terutama pelanggaran berat terhadap hak-hak asasi manusia.
“Sebab, mekanisme keadilan transisional (transitional justice), terlepas dari sedikit banyaknya, pasti mengandung elemen pengesampingan asas non-retroaktif.”
